Google received a set back on Friday in their attempt to challenge the use of the
Froogles.com,
according to the Associated Press. A three judge
panel of the ICANN, which has say over domain name conflicts, ruled against Google, who was claiming Froogles was too
similar to Froogle. Froogle is Google's online shopping comparison service.
"The dissimilar letters in the domain name are sufficiently different to make it distinguishable from Google's mark," the panel found. The name Froogles.com "creates an entirely new word and conveys an entirely singular meaning from the mark."
While the loss does not impact Google's use of the Froogle domain, said the AP, this may change since Froogles owner Richard Wolfe has filed a complaint of his own with the U.S. Patent Office. He claims Froogle is an infringment of his use of Froogles.
