eGoogle has reopened its once-lost trademark case against Froogles in a federal court. Froogles operates a discount-shopping directory that is quite different from Google's merchant-fed product engine. The owner of Froogles has refused to deal with Google in the past, a line of bargaining that would have allowed him to continue operating Froogles with no trademark ownership. Google contends, broadly (perhaps too broadly) that it may claim rights to any trademark built on —OOGLE. For the defense, Froogles can claim that Google allowed four years to pass before lodging its first complaint, and that Froogles preceded Froogle (but not Google). (Thanks to SEW.)
